You deserve to know how information you provide either online or offline is being used and collected. At The New 42nd Street, Inc. (“New 42”), we are committed to protecting your privacy. This Privacy Policy will advise you about how we protect your personal information, and about what choices you have concerning the use of that information. This policy applies to all personal information collected by New 42 and its projects, including the New 42nd Street Studios, The Duke on 42nd Street and The New Victory Theater. Please read this policy carefully. We may need to change this policy from time to time in order to address new issues and reflect changes on our site. We will post those changes here so that you will always know what information we gather, how we might use that information, and whether we will disclose that information to anyone.

The Information We Collect and How We Use It

We collect information on our site in order to make it possible for you to access all the features on our site and to enhance your overall experience at our venues. You will be invited to provide personal information, such as your name, mailing address, phone numbers, email address and your credit card information in order for us to process your ticket purchases, accept your donation or fulfill your request for information. This includes sending you transactional details such as receipts, confirmations and performance reminder emails or text messages. We also monitor customer traffic patterns and site usage to help us develop and improve design and layout. New 42 will not collect personal information about you without your knowledge and consent.

Information Shared With Third Parties

If you give us permission, we may use your contact data to send you information about performances, new offerings and special values at New 42 and we may also send third party offers from sources trusted by New 42 to our visitors who have indicated that they would like to receive these types of communications. You may always opt out of receiving future mailings by clicking the “˜Unsubscribe” link that appears at the conclusion of every email we send to you. We may also provide your contact data and other information you give us to third party renters of our theaters (“Renters”).

From time to time, we may provide your personally identifiable information to other merchants. However, we do not share your email address with other merchants, except as stated in the prior sections of our Privacy Policy. When we share your personally identifiable information with other merchants, we select merchants whose products or services we believe may interest you. If you do not want us to provide your personally identifiable information to other merchants, please email us at Ticket_Services@NewVictory.org or Duke_Tickets@New42.org. However, we will still share your personally identifiable information to process your transactions and to deliver the goods and services you have requested on this website. For example, for your own protection we will still share your mailing address with our credit card processing company to prevent unauthorized use of your credit card.

In addition, we may employ other companies or individuals (the “Outside Agents”), to perform functions on our behalf, which functions may include but not be limited to sending postal mail and email, conducting sweepstakes and other promotional activities, analyzing data, providing marketing assistance, processing credit card payments, providing customer service and building our mailing lists. Outside Agents have access to personal information needed to perform their functions. Other than Outside Agents and Renters, we keep all of your personal information private and will not share it with any third party, unless you have authorized us to or we are legally required to do so. New 42 may also release account information when we believe, in good faith, that such release is reasonably necessary to enforce or apply the provisions of our Terms of Use or to protect the rights, property or safety of New 42, our users, or others.

Demographic and profile data is also collected at our site. New 42 may provide such information in the aggregate to third parties without disclosure of personally identifying information. To provide you with access to related sites, our site contains links to third party websites. New 42 is not responsible for the privacy practices or the content of any of these linked sites. In the event we sell or buy businesses or assets, customer information will most likely be one of the business assets transferred during such a transaction. In the event that New 42 or substantially all of its assets are acquired, customer information will also constitute one of the transferred assets.

Donor Privacy Policy for The New 42nd Street

The New 42nd Street respects the privacy of all donors. Donor information is maintained in a secured database, and only authorized personnel have access to this information and only for appropriate business purposes. Paper records are stored or shredded securely. The New 42nd Street does not rent, sell, or trade donor contribution information with any other entity, although we may share (or ask that you share) such information with trusted third party payment processors when necessary to process donations made via credit card. Donors to our Family Benefit and to our Give A Kid a Seat campaign are automatically redirected from New 42 Sites to Give Lively for secure donation processing. Give Lively’s terms of use and privacy policy may differ from New 42 Sites and we encourage you to read them. Additionally, the New 42nd Street does publish a listing of donors in the New Victory playbill. We respect any and all donor requests to remain anonymous. The New 42nd Street may be legally required to disclose donor contribution information on occasion. The New 42nd Street complies with all applicable legal requirements and standards.

IP Address

New 42 tracks IP (internet protocol) addresses for system administration purposes. IP addresses are logged per user’s session and help to determine how often areas on our site are visited. New 42 does not track IP addresses with any of your personal information, so we will never link an IP address to a specific user. We also monitor traffic patterns and site usage to help us develop and improve the design and layout of the site.

Cookies

We use cookies to improve your website experience. “Cookies” are small pieces of information that a Web site transfers to your computer’s hard drive for record-keeping purposes. Cookies in and of themselves do not personally identify users, although they do identify a user’s computer. We use cookies to remember information customers give us so they don’t have to reenter it each time they visit our site. You are always free to decline our cookies if your browser permits. When you make a donation to New 42 or purchase tickets, we need to obtain your credit card number, expiration date and billing address information. This information is encrypted and transmitted over the Internet where it is stored in our Internet server, and used for billing purposes only. Our site has security measures in place intended to protect against the loss, misuse, and alteration of the information under our control. New 42 uses AES encryption to help ensure that all the personal information you provide is encrypted and remains private. This helps to maintain the confidentiality of your information. We strive to protect your personal information, however, New 42 cannot ensure or warrant the security of any information you transmit to us.

You Acceptance of These Terms

By visiting the New 42 websites, you consent to the terms of this Privacy Policy and to the collection and use of this information by New 42. We will always fully disclose our privacy policies, and we will promptly post any changes to our policy on this page.
